• White-label capabilities (Enterprise plans)

3. Account Registration & Security

3.1 Account Creation: You must provide accurate, complete, and current information during registration. You must be at least 18 years old or have parental consent to use the Service.

3.2 Account Security: You are responsible for:

• Safeguarding your password and account credentials
• All activities occurring under your account
• Immediately notifying us of unauthorized access
• Ensuring your account information remains current

3.3 Account Suspension: We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks to the platform.

4. Subscription & Billing

4.1 Subscription Plans: We offer various subscription tiers (Starter, Professional, Enterprise) with different features and limits. Plan details are available on our pricing page.

4.2 Billing: Subscriptions are billed monthly or annually in advance. All fees are in USD unless otherwise specified. Prices are subject to change with 30 days notice.

4.3 Refunds: We offer a 14-day money-back guarantee for new subscriptions. After this period, fees are non-refundable except as required by law.

4.4 Free Trial: Free trials are limited to one per customer. Credit card information may be required but won't be charged until the trial ends.

5. Content Ownership & License

5.1 Your Content: You retain all rights to content you create. By uploading content, you grant us a worldwide, non-exclusive license to host, store, transmit, display, and distribute your content as necessary to provide the Service.

5.2 Platform Content: All BlogStack.pro branding, features, and functionality remain our exclusive property and are protected by intellectual property laws.

5.3 Feedback: Any feedback or suggestions you provide become our property and may be used without compensation or attribution.

6. Prohibited Content & Activities

You may not use the Service to:

• Violate any laws, regulations, or third-party rights
• Post harmful, defamatory, obscene, or hateful content
• Distribute malware, viruses, or malicious code
• Engage in spamming, phishing, or fraudulent activities
• Attempt to gain unauthorized access to the platform
• Scrape, crawl, or use automated systems without permission
• Resell or redistribute the Service without authorization
• Impersonate others or misrepresent affiliations
• Interfere with platform operations or other users' enjoyment

7. Service Level Agreement (SLA)

7.1 Uptime Commitment: We target 99.9% uptime for paid plans, calculated monthly. Enterprise plans include 99.99% SLA with service credits for downtime.

7.2 Scheduled Maintenance: We perform maintenance during low-traffic periods with advance notice when possible. Emergency maintenance may occur without notice.

7.3 Support: Support response times vary by plan: Starter (48 hours), Professional (24 hours), Enterprise (1 hour for critical issues).

8. Data Protection & Privacy

8.1 Data Security: We implement industry-standard security measures including encryption, regular backups, and access controls to protect your data.

8.2 Data Portability: You can export your content at any time through our export tools. We support common formats including JSON, Markdown, and WordPress XML.

8.3 Privacy: Our Privacy Policy governs how we collect, use, and protect your personal information. By using the Service, you consent to our data practices.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOGSTACK.PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim. Some jurisdictions don't allow limitation of liability, so these limits may not apply to you.

10. Indemnification

You agree to indemnify and hold BlogStack.pro, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Modifications & Termination

11.1 Term Changes: We may modify these Terms at any time. Material changes will be notified via email or platform notice. Continued use after changes constitutes acceptance.

11.2 Service Changes: We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

11.3 Termination: Either party may terminate the agreement at any time. Upon termination, your access will be disabled, and you should export your data within 30 days.

12. Governing Law & Disputes

12.1 Governing Law: These Terms are governed by the laws of California, USA, without regard to conflict of law principles.

12.2 Arbitration: Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.

12.3 Class Action Waiver: You waive any right to bring claims as a plaintiff or class member in any purported class action or representative proceeding.
